when FDR became president, the Supreme Court was completely out of touch with America's realities. he had to threaten to pack the court to get it to start paying attention to why he and Congress were passing radical new legislation and programs. gradually, the obstructionists were replaced by jurists who were willing to work with the President and Congress to address the changing world. it was never a perfect system, but FDR's court eventually helped pave the way for modern civil rights and public good.
if Alito does make it to the Court, it's likely Roe will fall. but a conservative right-wing court will quickly prove itself as out-of-touch with America as the Court did in FDR's day. America is much more moderate than Alito, Scalia and Thomas. it will not take too many regressive decisions before national pressure is brought to bear on the Court -- and there will be an effect. we may lose this battle, and we may lose Roe, but once past those immediate losses will come new victories. the civil rights and liberties of the American people will move forward, not back. we will ensure that, even if the Court does not.
